Digital Millennium Copyright Act (“DMCA”) Policy

1. Overview of the DMCA
The Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”) provides a standardized legal procedure for copyright owners (including software developers, authors, photographers, and others) to notify online service providers of alleged copyright infringement and request removal of infringing content. This individual or department is responsible for responding to DMCA notices and counter notices. If you believe that content on Funnel Builder infringes your copyright, you (or your authorized representative) may send us a written notification following the requirements described below.

3. Important Considerations Before Filing a DMCA Notice
Tell the Truth. The DMCA requires that you swear to the accuracy of your copyright complaint under penalty of perjury. Filing a false DMCA notice can result in both civil and criminal penalties.

Investigate. Funnel Builder users often invest significant effort into creating their content. Before submitting a DMCA notice, ensure the content is indeed infringing and not protected by fair use, permission, or other legal exemptions.

Attempt to Resolve Amicably. If possible, contact the user who posted the content. Often, disputes can be resolved directly, without the formal DMCA process.

You May Receive a Counter Notice. The user who posted the content has the right to submit a counter notice if they believe your notice was mistaken or that their use of the content was lawful. If we receive a valid counter notice, we will re-enable the allegedly infringing content within 14 business days unless you notify us that you have filed a court action seeking a restraining order against the user.

We Are Not the Judge. Funnel Builder’s role is to process valid DMCA notices and counter notices. We do not make legal determinations regarding infringement or fair use.

4. How to Submit a DMCA Takedown Notice

4.1 Minimum Requirements of a Valid DMCA Takedown Notice
To be valid under the DMCA, your notice must include the following information (17 U.S.C. §512(c)(3)):

Identification of the work claimed to have been infringed, or if multiple works, a representative list of those works.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit Funnel Builder to locate the material (e.g., a URL or link to the relevant page).

Information sufficient for Funnel Builder to contact you, such as an address, telephone number, and email address.

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of the exclusive right that is allegedly infringed or authorized to act on the owner’s behalf.

A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

If your notice does not contain all of these elements, we may be unable to process it or may request additional information.

5. DMCA Counter Notice Procedure
If you believe that your content was removed or disabled as a result of an inaccurate or improper DMCA notice, you may send Funnel Builder a counter notice. The fastest way is via our online form:

Alternatively, you can email us at help@funnelbuilder.com with the following information (17 U.S.C. §512(g)(3)):

Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your name, address, telephone number, and email address.

A statement that you consent to the jurisdiction of the Federal District Court in the judicial district where your address is located, or if you are outside the United States, the jurisdiction of the Federal District Court where Funnel Builder is located, and that you will accept service of process from the person who originally provided the DMCA notice or an agent of such person.

A physical or electronic signature of the subscriber/user.

Once we receive a valid counter notice, we will forward it to the party who submitted the original DMCA notice. Unless that party notifies us within 14 business days that they have filed a court action against you, we will typically restore the content to our platform.

6. Repeated Infringement Policy
In accordance with the DMCA, Funnel Builder has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. If we determine that a user has repeatedly posted infringing content, we may terminate their account at our sole discretion.

7. Legal Rights and Remedies
Submitting a DMCA notice or counter notice is a serious legal matter. If you are unsure about your rights or whether the material in question is infringing, we strongly encourage you to consult with a qualified attorney. Funnel Builder cannot provide legal advice, and nothing in this policy should be construed as such.

8. Updates to This Policy
We may modify or update this DMCA Policy at any time. Any changes will become effective upon posting to our website. We encourage you to review this policy regularly.
